If informal resolution is unsuccessful, you agree to attempt to resolve the dispute through mediation. Mediation will be conducted by a mutually agreed-upon mediator in accordance with the rules of the American Arbitration Association (AAA) or similar mediation service. The costs of mediation will be shared equally between the parties unless otherwise agreed.
If mediation is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms of Use or our services shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Oklahoma City, Oklahoma, United States, unless both parties agree to a different location.
The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The costs of arbitration, including attorney's fees, will be allocated in accordance with the arbitrator's decision.
Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising under or relating to these Terms of Use shall be brought exclusively in the federal or state courts located in Oklahoma City, Oklahoma, United States, and you consent to the personal jurisdiction of such courts.
